Supreme Court case for former Mayor Lyn Howard opens with questions about constitutionality
If a police officer pulls over a motorist and violates his or her Fourth Amendment rights under the U.S. Constitution, should a prosecutor be able to charge that motorist with a crime under the Illinois Constitution?
That was one scenario argued by Pekin attorney Gerald Hall, former Pekin Mayor Lyn Howard's attorney, before the Illinois Supreme Court on Wednesday in an effort to overturn Howard's conviction on three counts of official misconduct for using the city of Pekin credit card to gamble at a casino.
