Lawsuit filed in death of Chicago teen

</element><element id="paragraph-1" type="body"><![CDATA[A wrongful death lawsuit has been filed against relatives of a Chicago man accused of fatally punching a teenager on an Indiana beach on July Fourth.

James Malacek is charged with aggravated battery, involuntary manslaughter and battery in the death of 17-year-old Kevin Kennelly of Chicago. He has pleaded not guilty to the charges.

The Chicago Tribune reports (http://trib.in/wZ2ZFc ) that the lawsuit filed in Cook County Circuit Court by Jean and Kevin Kennelly Sr. names Malecek, then 19, his sister and their mother, Marguerite.

The lawsuit alleges James Malecek and his sister were drunk and she instigated a dispute that led to Kennelly&#39;s death. Marguerite Malecek is accused of permitting her minor daughter to consume alcohol.

James Malecek&#39;s defense attorney, James Voyles, on Thursday declined comment on the lawsuit.
