New judge will be appointed in Raymond Moss case
</element><element id="paragraph-1" type="body"><![CDATA[The State's Attorney's office filed a motion to substitute judges in the aggravated criminal sexual assault case against Raymond Moss.
Moss, 46, 724 Beggs Place, Harrisburg, is charged with a single count of aggravated criminal sexual assault in connection with an incident that took place Oct. 15.
A brief hearing was held Thursday on the matter. The motion states Judge Walden Morris is prejudiced against the state in this particular case, which means the state will not get a fair trial. No proof is required - the motion must simply be granted the first time a substitution is requested.
Moss, through his attorney, Public Defender Lowell Tison, said he wanted to have a hearing on the matter, but the request was denied.
"That's a matter of right," Morris said of the state's motion.
A motion to reduce bond, currently set at $1 million, will have to be heard when another judge is assigned to the case. A hearing on that motion was set for Thursday. That may be the reason Moss wanted to rise to the defense of Morris.
The case will be referred to the chief judge of the First Circuit for
reassignment to another judge.
Moss remains held at the Saline County Detention Center until $100,000 cash, $1 million collateral or a smaller bond can be secured.
Moss was indicted on the charge by the grand jury on Tuesday. He had been charged by bill of information Oct. 15, shortly after his arrest.
