No bail for man accused of attacking girlfriend in hospital

A Framingham man was ordered held without bail yesterday when he was arraigned in Framingham District Court on charges he assaulted his girlfriend in the MetroWest Medical Center's emergency room.

Javier Antonio Baez, 21, also shoved a patient on his broken arm as he ran away from Framingham Union security officers after the incident on Monday, police spokesman Lt. Paul Shastany said.

Baez was arrested Tuesday at 2:40 p.m. at his 240 Beaver St. home, a day after the alleged assaults, the lieutenant said.

On Monday, Baez's girlfriend, who police did not identify, had gone to the hospital with unspecified injuries, suspected of being from another domestic incident.

Once there, Baez began screaming at the woman in a small, curtained-off area, causing a hospital employee to try to calm things down.

``When she opened up the curtain, she saw Baez, with a closed fist, punch the victim right in her face,'' said Shastany. ``It was a very hard hit, and when he saw the hospital employee, he pushed her and ran.''

The punch was witnessed by several other people, and security chased Baez.

``An older patient was standing outside of the lobby, and he had a broken arm,'' said Shastany. ``Mr. Baez ran by him, and pushed him on the arm, aggravating the injury.''

Police officers interviewed the victim, who first claimed she broke her nose by slipping on the ice. But, after police told her what the witnesses said, she said the police ``were making a big deal out of nothing.''

She said she did not want Baez arrested.

Baez was charged with two counts of assault and battery - one on his girlfriend and one on the patient with the broken arm.

Baez will be held at the Middlesex Jail in Cambridge. He is due back in Framingham District Court on Jan. 23 for a pretrial conference.
