DUI TEST UNDER FIRE IN COURT: Recent state Supreme Court decision is, potentially, a serious blow to DUI investigations. The court ruled that horizontal gaze nystagmus (HGN) tests do not have the presumption of scientific validity. These are the tests where an officer holds a pen about a foot from your face, moves it from one side to another and watches your eyes to see if your pupils jerk. The feds say it's the most accurate test on the planet, short of drawing blood or testing breath, to determine if someone's drunk. But HGN tests aren't admissible in at least three states.
