Motions hearing set for Rushing

Timothy Rushing appears headed for a spring trial in his criminal sexual assault case.

The 41-year-old Rushing, of Chester, appeared in Randolph County court on Dec. 21 with attorney Bill Carroll of Whitton Group LLC and waived his right to a speedy trial.

"We've had this case for two weeks," Carroll told Judge Richard A. Brown. "(Rushing) wishes to take the time necessary to defend his case."

Rushing has been formally charged with one count of criminal sexual assault in alleged connection to an incident occurring in Chester on Sept. 18. He has been incarcerated in Randolph County Jail on a $150,000 bond.

Criminal sexual assault is a Class 1 felony with a punishment range of four to 15 years in prison, if convicted.

Randolph County State's Attorney Jeremy Walker filed a motion in limine on Dec. 8, asking the court to to make a determination to admit other alleged acts of Rushing into the case.

The motion further requests the court to conduct a hearing regarding the admissibility of the statements of two additional alleged victims of Rushing, identified only by the initials "M.B." and "M.H." in court documents.

The court is expected to hear arguments on that motion and any others that are pending on January 16 at 1 p.m. The next jury setting for Randolph County is April 2 through April 20.
